OVERVIEW

This website is operated by TÜ Spire. Throughout the site, the terms “we”, “us” and “our” refer to the staff of TÜ Spire. TÜ Spire offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with an online e-commerce platform that allows us to sell our products and services to you.

PLACING AN ORDER

Add the desired products to your shopping cart. Fill in all of the required fields and choose the most suitable shipping method to complete the order. The total cost is then displayed on the screen. This can be paid securely via PayPal, Direct Bank Transfer (SEPA banks) or the following payment methods provided by Maksekeskus AS:

- Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay, Citadele
- Latvian bank payments: Swedbank, SEB, Citadele and Luminor
- Lithuanian bank payments: Swedbank, SEB and Luminor, Šiaulių Bankas
- Buy now, pay later: Indivy, Indivy 3, Liisi ID, BigBank, Moki3, Mokilizingas
- Finnish bank payments: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästöpankki, OP, POP Pankki, S-Pankki, Säästopankki
- Card payments: Visa, MasterCard
- Gift card: Kniks gift card

NB! When using a bank link payment confirm the order and then click on the ‘Return to merchant’ button.

The personal data necessary for the execution of payments is transferred to authorized processor PayPal or Maksekeskus AS. The contract enters into force when the amount payable is transferred to the bank account of the online store. If we cannot deliver the ordered goods due to any reason, the purchaser will be informed as soon as possible and the money paid (including the shipping cost) will be refunded promptly, but no later than within 14 days of receiving the notification.

SHIPPING

All patterns are available as PDF files.

When checking out with PayPal or MakeCommerce (Maksekeskus), you will receive an email with a download link once your payment has cleared, usually within minutes.

When paying with direct bank transfer, you will receive an email with a download link within 24 hours of cleared payment. Although most bank transfers are completed within 48 hours, please keep in mind it can take a few days during weekends and holidays.

Physical Items

All toys and toy kits will be shipped within 3 business days of cleared payment from Tallinn, Estonia, unless stated otherwise in the item description. All items will be shipped with priority airmail through Omniva and come with tracking. I will send the tracking number to your email address once the item has shipped. Delivery time depends on your location:

- Estonia: 2 - 5 business days
- Europe:  5 - 15 business days
- USA and Canada: 10 - 15 business days
- Australia and New Zealand: 10 - 20 business days
- Latin America and the Caribbean: 10 - 20 business days
- Rest of the world: 10 - 20 business days

I do my best to calculate shipping costs accurately, but if you are charged more than the actual cost, I will refund the difference.

Shipping upgrades
If you need your order sooner than the shipping times listed above, I can use a courier service EMS or DHL. Additional shipping charges will apply, starting at 48 EUR. Please contact me for details at kristi@spire.ee before submitting your order.

Shipping address
Please make sure you provide the correct shipping address during checkout. Unfortunately, I am unable to offer any refunds if the address provided was incorrect.

Customs
Any customs charges, local sales tax or import duties will be paid by the buyer. Please make sure you are aware of your local laws and regulations before making a purchase.

RETURNS

Unused, undamaged items may be returned for full refund within 14 days of receiving. Shipping charges are not refundable. I reserve the right to decline refund if items have been damaged. Please keep that in mind when packaging items for shipping.

You will be responsible for paying shipping costs for returning your item. Shipping costs are non-refundable.

If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. Unfortunately we cannot guarantee that we will receive your returned item if you decide to not use tracking service.

The right of withdrawal does not apply if the purchaser is a legal person.

Digital Products
Due to the nature of digital files, all pattern sales are final and no refund is offered once the files have been sent and/or downloaded.

Damaged items
If the items you ordered have been damaged, please send a photo of the items and packaging to kristi@spire.ee. I will reship, if possible, or refund your payment.

Refunds (if applicable)
Once your return is received and inspected, I will contact you through email to notify you of the approval or rejection of your refund. If you are approved, your refund will be processed, and a credit will automatically be applied to your original method of payment, within one business week.

DIRECT MARKETING AND PROCESSING OF PERSONAL DATA

The online store only uses the personal data entered by the purchaser for processing the order and sending goods to the purchaser. The online store forwards personal data to the transport service provider in order to deliver the goods. The online store sends newsletters and offers to the purchaser’s e-mail address only if the purchaser has expressed their wish to receive them by entering their e-mail address on the website and indicating their desire to receive direct mail. The purchaser is able to opt-out of offers and newsletters sent to their e-mail address at any time by letting us know via e-mail or by following the instructions in an e-mail containing an offer.

Your submission of personal information through the store is governed by our Privacy Policy.

MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Certain content, products and services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website.
